Terms of service
The short version
ClipYA connects surf photographers with the surfers they shoot. Photographers own their images. We host them, watermark the previews, take payment, and pass on the photographer's share. Nothing on this site transfers ownership of a photograph to us.
Your account
You must be 13 or older to hold an account, and 18 or older to sell. One person per account. You are responsible for what happens under your login, so use a password you do not use elsewhere. We can suspend an account that breaks these terms, and you can delete yours at any time from settings.
What photographers agree to
You keep copyright in everything you upload. By uploading you grant ClipYA a non-exclusive license to store your files, generate watermarked previews, display them across the site, and sell licenses on your behalf under the terms you set.
You also grant ClipYA a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, edit, adapt, display and distribute anything you upload in ClipYA's marketing and advertising, in any medium, without further notice or payment. See privacy for the detail.
You confirm, for every upload, that you took the photograph or hold the rights to sell it and to grant these licenses. Uploading someone else's work is copyright infringement; each upheld claim is a strike, and three active strikes removes the account automatically (see community rules).
Your likeness
If you hold a ClipYA account and appear in content uploaded to ClipYA, you consent to that content — including your likeness — being used in ClipYA's marketing and advertising as described above.
What buyers agree to
Buying a clip buys a license, not the copyright. What each license allows is set out in the image licensing document. Previews are watermarked and stamped with the account that viewed them; removing a watermark, circumventing the paywall, or redistributing a preview is a breach of these terms and of copyright law.
Payments
Prices are set by photographers. Payment is processed by Stripe; we never see your card details. ClipYA retains a platform fee from each sale, disclosed in the photographer agreement. Because a digital file cannot be returned, sales are final except where a file is corrupt, is not what was described, or was sold by someone without the right to sell it. Contact us and we will make it right.
Tags
A tag on a photograph is a claim that you are the person in the water. Only the photographer can approve it. Claiming a wave that is not yours is grounds for removal.
Liability
The service is provided as it is. We do not guarantee that any given session will be photographed, that a photographer will approve a tag, or that the site will be available without interruption. To the extent the law allows, our liability to you is limited to what you have paid us in the twelve months before the claim.
Changes
We will post material changes here and email account holders at least fourteen days before they take effect. Continuing to use the site after that means you accept them.
